This is the last will and testament of me, James Stuart of Cromwell in the provincial district of Otago, New Zealand. Hotelkeeper.
I hereby revoke all former wills made by me. After payment of all my debts, funeral and testamentary expenses I give, devise and bequeath all my real and personal estate as follows :
To my wife, Susan Stuart, I give all my chattel property of whatever kind and description, money in bank or elsewhere, outstanding debts due to me and stock in trade in the house for her own use and benefit absolutely. I also give to my wife Susan Stuart, sections 16, 17, 18, 19, 20 and 21, Block IV town of Cromwell together with all buildings and appendages there on known as the Victoria Hotel, and sections 1 and 8 and part of section 2 and 9, Block IIIX, town of Cromwell together with all buildings and appendages thereon, together with all monies accruing therefrom during her natural life. At the demise of my wife, sections 16, 17, 18, 19, 20 and 21, Block IV Cromwell shall become the property of James Stuart Varcoe, son of Richard Varcoe of Cromwell, miner, and sections 1 and 8 and part sections 2 and 9, Block IIIX, town of Cromwell shall became the property of Susan Varcoe, wife of Richard Varcoe of Cromwell for her sole use and benefit. In the case of the aforesaid James Stuart Varcoe predeceasing my wife Susan Stuart or in the case of his death before he attains the age of twenty one years, the property left to the said James Stuart Varcoe shall become the property of Cyril, the natural son of Sarah Varcoe and grandson of Richard Varcoe of Cromwell aforesaid his heirs administrators and assigns. I give to Richard Varcoe of Cromwell, son, miner, Section 5, Block 1, Cromwell District for his sole use and benefits, and I hereby appoint my wife Susan Stuart and James Horn of Bannockburn, merchant, or the survivors of them executors of this my will, and I further leave the aforesaid James Horn, my executor the sum of five pounds sterling (£5) to be paid out of the estate of my wife each and every year and then from the estate of James Stuart Varcoe to be paid each and every year until the said James Stuart Varcoe attains the age of twenty one years, or on the event of his death prior to attaining the age of twenty one years then from the estate of Cyril Varcoe until he attains the age of twenty one years.
